Thanks, that makes a lot more sense to me, than the snippets that was being mentioned. I have experience of the OSHA rules from overseas construction contracts that had them written in, under the ''Standards and Specifications'' of the main contract details.

OK, i understand where your coming from now.  But i fail to see how a worker can legally sign away 12hr working day/7 days a week, without pay!!!. It's one thing to sign away (for arguments sake) 30 minutes, than it is to sign away 12hrsx7 days and totally without pay. Board and meals wouldn't come anywhere near compensation for 12hrs/7 day a week working. At least Shaun, you get paid for the other hours you spend at your place of work!!!

For a start they would deemed to be in an ''unsafe working environment'' as everyone would be in the same position as themselves, ..ie they would all be working in or around a working kitchen, ..Fire hazards, open hot cooking areas, rotating machinery, sharp hand utensils etc, etc When due to the length of there working day, are not deemed to be fit enough to carry out there duties in a safe and diligent manner.... In other words, it's bloody dangerous to be working 12 hrs in a busy kitchen when your going to be inherently tired, that's when Bad Accidents happen.

So, i'm pretty sure that your federal, and even your state labour laws wouldn't allow any of what this employer is doing to/with his workers.

Another thing, Don't you have local Public Health and Safety inspections, at such food outlets?? In UK/(Europe) when they visit such businesses, one of the things they ask to see is employee contracts.
As contracts of those working over (i think) 16hrs a week, have to be in registered and in compliance  with County Council authority requirements...

It does seem you have many ways around your labour Laws!!
It reminds me a lot of your National Electric Codes, where it can state a rule, and then proceeds to give about 10 exceptions, which just about wipes out the original rule!!  haha!!

Jokes apart, this owner has just got to be breaking umpteen different federal and state rules...... Isn't he????

David, this is my last word on this.  I agree that 1 hour a day does not compare to the 12 hours of the restaurant workers.  My point is that companies have the ability to change the law to fit their needs.  All they need do is to get the employee to sign it.

The purpose of wage and hour programs is to protect the employee not the employer.  Like everything else our government this provision has run amuck.

Not in Aus Mate....nor anywhere else for that matter. It is not possible under Common Law to allow/entice/cajole or bully someone into breaking the Law. Neither is any such signature that endorses the breaking of a Lawful Condition lawful in itself.

Any person/Business that entices an employee to break the Law with such a signature are themselves breaking the Law !!!

It is a defence that is often used in Common Law and has been thrown out and overturned so many times that it is hardly worth the bother of a defense......however, if the signatory does not complain...then nothing gets done. Usually, fear and concern prevent many disadvantaged people from making a legitimate complaint, which under a Westminster type system would certainly succeed !!

I just got home from doing some electrical. What a bowl of spaghetti? Whoever did this wiring just shouldn't. Same for the construction part of this job too. A 2 day job has turned into a week so far?

That's exactly how I feel about the whole thing David . If they want to take it further , I will help them . If not , I'm not going to stir-up the Pot .

I'm on my way back in a few minutes. I spoke with the boss about it. It seems he bought the place like this? But this extension of the showroom (it's a store) was done like 10 years ago? Three circuits, two tied together? The power for the lighting is out of two boxes but only one switch? On top of that the power wire and natural wire were mixed? Each box had the colors mixed, blk to wht, blk to grn? None of this is more then 12 feet apart? I sent a change order, changed my fee. hehe  Oh yeah another mess? Garage door openers? Power going up to a recep (plug) then over to another then an extension to another recp box? and then to another box for power? Wonder why the motors don't work? hehe 240v on one 14g wire for a 120v motor?

#14 wire don't get it drawing that much power.  i would have used #12 or #10 for the amps.  Wonder why no one was zapped...:icon_cheesygrin:  Turn on the power, and half of Orlando goe's dark...hahaha

I think, but not sure, that even Canada is using metric cable sizes!!
So what's the big deal with sticking to your antiquated AMG??

Then shame on you, your stuck with the only other country in the world that uses this old and antiquated wire sizing! Has nobody told you, ...The modern world is now ''Metric'' ??....hahaha!!!

Neil, is there an on-line version of your Canadian National Electric Codes?? It would be interesting to have a look through them...
