K-3 Visa petition is gone

This is what I just got from my Lawyer.
"The National Visa Center is no longer processing K3 visa petitions.  K1 visas are still available. CR visas are available for spouses of US Citizens."

I dont know yet what is happening with people who have already filed. I would suggest you check with your attorney.Here is the latest from Lolly & Assoc.

"It depends on what stage of filing they are in.  If the I-129F petition is already at the embassy, they only need to follow through with the rest of that processing.  However, if they were recently approved by USCSI, they should check if  their I-129F petitions are still open with the NVC.  If not, and you have not yet received the NVC Invoice for processing fees, you will want to request that they resend it to you.  You will pay the fees to process the CR visa and make a second filing to the NVC."

Which for me means starting all over again.  What a crock of sh**

Sarge that really does suck.The government changing the rules.

I guess my question is Did Lolly just tell you .Oh were sorry you have to start all over.I can't beleave they didn't know this was coming.

The government changed the rules about half way threw me and my wife's visa application.But Holmes and Lolly knew about the change and they sent me more paperwork to fill out.So I filled it out faxed it back to them.And we were off and running.With a 2 day delay.

I would give Holmes and Lolly 24 hours.And then light them up.For not knowing about this.And for Not telling you about the possible change.

I guess the point I'm trying to make.Is when the changes do come down.The changes are not right now.They talk about this stuff.They debate this stuff.Somebody has got to ask somebody else if the changes.Are all right.Holmes and Lolly should of known months ago.

This policy change took affect on Feb 1 2010 so i guess my question is when did
you file your papers? Also the k-3 visa didnt go away it is just to be applied for in
the country were you got married after feb 1 2010.  so any newbies who got married
in China in the future can go to our embassy here in Bejing or any one of the consulates
here in China and start the process before they leave.

did they tell you that you would have to start all over? wow that would
be a crock if you have to start over and the pay all the money again.

but i think Maxx meant  it is a crock and was asking if they said would
you have to start over which is B******* if your back to square one
again.  but also as a law firm you would think that they new of the upcoming
pending change in the law as it was in print that this would happen in 2/1/2010
so maybe this would help you in the change and not having to pay the fees all
over again. just a thought

JimB from what I just read.On the official immagration web page.Immagration should be contacting you in a few days.And they will tell you how to proceed.Which ussley means.That you are going to have to fill out a different form.I don't know for sure.But it sounded like to me that it is just a bump in the road.

married in China. you ca see what is required and they will also
do the digital fingerprint scan there.

there is a list of 10 things required for the interview.  i would
definetly talk with Lolly and assoc. as they SHOULD have been
aware of this UPCOMING CHANGE.

as for getting married in China then the k3 will have to be
done in China as that is were you were married. they are no
longer processing k3 from the US.  so for you Shaun then the
option will be k1 unless you start the process here when you
come back to marry Peggy. look on the site and see the 10
items you will need and be prepared when you get back and
you could start the process here. dont forget the costs involved
as they will want that. not sure of the conversion but i will venture
to guess about 10,000 rmb

Ted,  I hope it is the topic for this evening with Peggy.  One never knows.  I saw where Scott may have 100 days to the visa.  Looks real appealing to me.  I also want to go back at least the last week of June through most of July.  There is a lot of work to be done and Peggy and I are working hard on the clothing thing.  Her brother who lives in Guangzhou has thrown his hat in the ring by helping us to get her appointments in Shenzhen with sewing and cloth companies.  She had her first appointment yesterday morning and is waiting for a bid.
